BY THEPRESIDENT OF THEPHILIPPINES EXECUTIVE ORDERNO.ao IMPLEMENTATION OF THE THIRDTRANCHEOF THE MODIFIEDSALARY SCHEDULE FORCIVILIANPERSONNEL AND BASEPAY SCHEDULE FOR MILITARY AND UNIFORMED PERSONNEL IN THE GOVERNMENT WHEREAS,the PhilippineGovernment has adoptedthe modifiedSalary Schedulefor civilianpersonneland the Base Pay Schedulefor militaryand uniformedpersonnelas authorizedin the Senateand Houseof Representatives t ResolutionNo. 4 (s. 2009)whichshallbe implemented in four (4) yearly tranches for personnel government in national (NGAs); agencies WHEREAS, for personnel in government-ownedor controlled (GOCCs),governmentfinancialinstitutions corporations (GFls),and local government units(LGUs),the implementation of the modifiedSalarySchedule shall be in at leastfour (4) years dependingon their financialiapabilities, pursuant to item(13)of the tResolution; WHEREAS,the firsttrancheof the modifiedSalaryScheduleand Base Pay Schedulehave been implemented effective1 July 2009 for personnelin NGAs,Goccs, and GFls,andeffective1 January2a10for personnelin LGUs; WHEREAS, the secondtrancheof the modifiedSalaryScheduleand Base Pay Schedulehave been implementedeffective24 June 2O1Afor personnelin NGAs, GoCCs, and GFls, and effective1 January2011 for personnel in LGUs;and WHEREAS,RepublicAct (RA) No. 10147,the Fy zo11 General Appropriations Act (GM), providesappropriations under the Miscellaneous PersonnelBenefitsFund(MPBF)for the implementation of the thirdtrancheof the modified SalarySchedule andBasePaySchedule for personnel in NGAs; Now, THEREFORE,l, BENIGNOs. CivilianPersonnel- The compensation adjustments clueto the implementation of the thirdtrancheof the modifiedSalarySchedule shall cover all positionsfor civilianpersonnelin the Executive, Legislative, and Judicial Branches, the Constitutional

Commissions/Offices, State Universitiesand Colleges,GOCCs, GFls,and LGUs,whetherregular,casual,or contractual in nature, appointiveor elective,on full-timeor part-timebasis,now existing or hereaftercreated. (b)
- The compensation Militaryand Uniformed Personnel adjustments due to the implementation of the thirdtrancheof the modifiedBase Pay Scheduleshall cover the military personnelunder the Department of NationalDefense(DND)and uniformedpersonnel (DILG), underthe Department and LocalGovernment of the Interior PhilippineCoast Guard (PCG), and National Mapping and ResourceInformation Authority(NAMRIA).
(c)
The followingare excludedfromthe coverageof the compensation adjustments: (i)
lndividualsand groups of people whose servicesare engagedthroughjob orders,contractsof service,or others similarly situated; and
(ii)
Civilian personnelin governmententities which are exemptedfrom RA No. 6758 and are authorizedby law to adoptandareactually implementing theirowncompensation and positionclassification systemsapprovedby the Officeof the President.
SECTION2. lmplementationof the Third Tranche Monthly Salary Schedulefor Civilian Personnelof the NationalGovernment.The Salary Scheduleattachedas Annex"A,"whichis the thirdtrancheof the modifiedSalary providedin item(4Xb)of tResolution Schedule No.4, shallbe implemented 1 June2011for personnel effective in NGAs,andin GOCCsandGFls. SECTION3. lmplementation of the Third TrancheMonthlyBase Pay Schedulefor Military and UniformedPersonnel.The Base Pay Schedule attachedas Annex "8," which is the third trancheof the modifiedBase Pay Schedulein item (8) of tResolution No.4, shallbe implemented effective1 June2011. SECTION 4. lmplementationof the Third Tranche Monthly Salary Schedulefor LGU Personnel.The implementation of the thirdtrancheof the modifiedSalarySchedulefor LGU personnel shall be determinedby the sanggunian concernedbasedon the LGU incomeclassand financialcapability: Provided,That such salary rates shall not exceed the followingapplicable percentages of the ratesin Annex"A,"pursuantto item(7)(a)of tResolution No.4: Provided,Further,Thatthe resultingPersonalServices, (PS)costshallnot exceedthe PS limitation in LGUbudgets, as provided underSections325(a)and

For NGAs,the amountsshallbe chargedagainstthe appropriation for the purposeunderthe MPBF in the FY 2011 GAA and from availablesavings.Thereafter, such amountsas may be needed shallbe included in theannualGAA;
(b)
For GOCCsand GFls,the amountsshallbe chargedagainsttheir respectivecorporatefunds in the approvedcorporateoperating budgets; and
(c)
For LGUs, the amountsshall be chargedagainsttheir respective localgovernmentfunds.
SECTION 7. Uniform lmplementationin Case of Insufficiencyof Funds. (a)
GOCCsand GFlswhichdo not haveadequateor sufficient funds shall implementsalary scheduleswhich shall be at uniform percentages of the ratesin Annex"A."

(b)
LGUswhichdo not haveadequateor sufficient fundsto implement the salaries authorizedfor their LGU income classes shall implementsalaryschedules whichshallbe at uniformpercentages of the rates in the respectiveThird Tranche Monthly Salary Schedules for LocalGovernment Personnel.
SECTION8. lmplementingRules and Regulations.The DBM shall issuethe necessaryrulesand regulations to implement this Executive Order. SECTION9. SeparabilityGlause.lf anyprovision of this Executive Order is declaredinvalidor unconstitutional, the otherprovisionsnot affectedthereby shallremainvalidandsubsisting. SECTION10. RepealingClause.All orders,rules, regulations, and issuances, or partsthereof,whichare inconsistent withthis ExecutiveOrder,are herebyrepealed, amended, or modified accordingly. SECTION11. immediately.
Effectivity. This ExecutiveOrder shall take effect
