Short t it le and com m encem ent .- ( 1) These rules m ay be called t he Energy Conservat ion ( Energy Consum pt ion Norm s and St andards for Designat ed Consum ers, Form , Tim e wit hin which, and Manner of Preparat ion and I m plem ent at ion of Schem e, Procedure for I ssue of Energy Savings Cert ificat e and Value of Per Met ric Ton of Oil Equivalent of Energy Consum ed) Rules, 2012. ( 2) They shall com e int o force on t he dat e of t heir publicat ion in t he Official Gazet t e. 2.

Definit ions.- ( 1) I n t hese rules, unless t he cont ext ot herwise requires, ( a) "Act " m eans t he Energy Conservat ion Act , 2001; ( b) "baseline year" m eans t he year in which t he base level of energy consum pt ion is used as a reference point for est ablishm ent and assessm ent of perform ance wit h regard t o com pliance of energy consum pt ion norm s and st andards under rule 4 and rule 6 respect ively; ( c) " cert ificat ion" m eans t he process of cert ifying t he verificat ion report or checkverificat ion report by t he accredit ed energy audit or t o t he effect t hat t he ent it lem ent or requirem ent of energy savings cert ificat e is quant ified accurat ely in relat ion t o com pliance of energy consum pt ion norm s and st andards by t he designat ed consum er during t he t arget year; ( d) "check- verificat ion" m eans an independent review and ex- post det erm inat ion by t he Bureau t hrough t he accredit ed energy audit or, of t he energy consum pt ion norm s and st andards achieved in any year of t he t hree year cycle which have result ed from act ivit ies undert aken by t he designat ed consum er wit h regard t o com pliance of t he energy consum pt ion norm s and st andards; ( e) " cycle" m eans t he period of t hree years available t o a designat ed consum er t o com ply wit h t he energy consum pt ion norm s and st andards;

(f)

"energy consumption norms and standards" means the specific energy consumption of the designated consumer for the specified zyxwvutsrqponmlkjihgfedcbaZYXWVUTSR year not ified under clause ( g) of sect ion 14;

( g) "Form " m eans t he form annexed t o t hese rules; ( h) " Rules 2007" m eans t he Energy Conservat ion ( t he form and m anner for subm ission of report on t he st at us of energy consum pt ion by t he designat ed consum ers) Rules, 2007 notified in the Official Gazette vide number G.S.R 174 (E), dated the 2 nd March, 2007; ( i)

"Rules 2008" m eans t he Energy Conservat ion ( Form and Manner and Tim e for Furnishing I nform at ion Wit h Regard t o Energy Consum ed and Act ion Taken on Recom m endat ions of Accredit ed Energy Audit or) Rules, 2008 not ified in t he Official Gazet t e vide num ber G.S.R 486(E), dated the 26 th June, 2008;

"Schedule" means the Schedule annexed to these rules;

( k)

"sect ion" m eans a sect ion of t he Act ;

(

I)

"specific energy consum pt ion" m eans t he rat io of t he net energy input int o t he designat ed consum ers' boundary t o t he t ot al quant it y of out put export ed from t he designat ed consum ers' boundary, calculat ed as per t he following form ula: specific energy consum pt ion = net energy input int o t he designat ed consum ers' boundary t ot al quant it y of out put export ed from t he designat ed consum ers' boundary and expressed in t erm s of t he m et ric t on of oil equivalent ( t oe) / per unit of product ;

( m ) " t arget year" m eans t he year by which a designat ed consum er shall achieve com pliance wit h t he energy consum pt ion norm s and st andards; . ( n) "verificat ion" m eans a t horough and independent evaluat ion by t he accredit ed energy audit or of t he act ivit ies undert aken by t he designat ed consum er for com pliance wit h t he energy consum pt ion norm s and st andards in t he t arget year com pared t o t he energy consum pt ion norm s and st andards in t he baseline year and consequent ent it lem ent or requirem ent of energy savings cert ificat e; ( o)

"year" m eans t he financial year beginning on t he 1 st day of April and ending on the 31 st day of March following.

Words and expressions used herein and not defined but defined in the Act shall have the meanings respectively assigned to them in the Act.

3. Est ablishm ent of energy consum pt ion norm s and st andards.- ( 1) The Cent ral Governm ent , in consult at ion wit h t he Bureau, shall est ablish, am end or rescind t he energy consum pt ion norm s and st andards for designat ed consum ers as not ified under clause ( g) of sect ion 14. (2) The energy consum pt ion norm s and st andards shall be specific for every designat ed consum er and shall be det erm ined as under: ( a) where energy audit of t he designat ed consum er' plant has been com plet ed, energy saving m easures and act ion plan for t heir im plem ent at ion has been finalised in consult at ion wit h t he energy m anager of t he plant under regulat ions 4 and 5 of t he Bureau of Energy Efficiency ( Manner and int ervals of Tim e for Conduct of Energy Audit ) Regulat ions, 2010,t he energy consum pt ion norm s and st andards shall be based on t he t im ely subm ission of Form 2 and Form 3 under Rules 2008; ( b) where energy audit of t he designat ed consum ers' plant has not been com plet ed or under t aken, t he ener gy consum pt ion nor m s and st andar ds shall be det erm ined t aking int o t he following fact ors, nam ely: ( i) average rat e of reduct ion in specific energy consum pt ion across all t he designat ed consum er sect ors' det erm ined on t he basis of t he analysis of dat a of t he last t hree years; ( ii) policy obj ect ives of keeping t he t arget of reducing t he specific energy consum pt ion a few percent age point s above t he average rat e of reduct ion keeping in view t he incent ive provided t hrough t he issue of energy savings cert ificat e. Where t he energy consum pt ion norm s and st andards have been det erm ined in (3) accordance wit h clause ( a) or clause ( b) of sub- rule ( 2) , t he said m et hodology shall not be reviewed aft er t he com m encem ent of t he energy consum pt ion norm s and st andard not ified under clause ( g) of sect ion 14. (4) The designat ed consum er s shall achiev e com pliance w it h t he ener gy consum pt ion norm s and st andards as not ified under clause ( g) of sect ion 14 wit hin a period of t hree years from t he dat e of com m encem ent of t he said not ificat ion.

4. Procedure for est ablishm ent of energy consum pt ion norm s and st andards.- ( 1) For t he purpose of est ablishm ent of energy consum pt ion norm s and st andards, t he t echnical com m it t ee set up by t he Bureau shall( a) calculat e specific energy consum pt ion in t he baseline year and proj ect ed specific energy consum pt ion in t he t arget year covering different form s of net energy going

into the boundary of the designated consumers' plant and the products leaving it over the relevant cycle on a gate-to-gate basis; (b) zyxwvutsrqponmlkjihgfedcbaZYXWVUTSRQPONMLKJIHGFEDCBA in calculat ing t he net energy input t o t he plant ,( i) convert t he calorific values of all form s of energy sources int o a single unit , nam ely, t on of oil equivalent using t he conversion form ulae specified in t he Governm ent of I ndia, Minist ry of Power not ificat ion num ber 8.0.394( E) , dat ed t he 12t h March, 2007; ( ii) consider all form s of energy t hat is, elect ricit y, solid fuel, liquid fuel, gaseous fuel, or any ot her form of energy im port ed int o t he plant for consum pt ion as energy for product ion of out put ;

(iii) not take into energy consumed in the colony attached to the plant, temporary or major construction work, and for outside transportation system or energy consumed through renewable energy sources not connected to the grid; ( iv) t ake int o t he energy export ed out of t he designat ed consum ers' boundary; ( v) if any designat ed consum ers' plant does not have disaggregat ed figures for energy consum ed, consider t he net energy consum ed for calculat ion bot h in baseline year and in t he t arget year: Provided t hat t he said designat ed consum er shall give adequat e reasons t hat it was not feasible t o m ake adj ust m ent for energy consum ed in t he colony. t em porary or m aj or const ruct ion work: Pr ov ided fur t her t hat such designat ed consum er shall m ak e necessary arrangem ent s for disaggregat ion of dat a for energy consum pt ion t o ensure t hat act ual energy consum ed for product ion is considered in t he next cycle; ( vi) where m ore t han one product is produced, select t he m ain product produced or an equivalent product worked out from t he product m ix as per st andard pract ice prevalent in t he concerned designat ed consum ers sect or: Provided t hat w here t he product ion of t he said m ain product is st opped, t he designat ed consum er shall inform t he necessary det ails in t hat regard t o t he Bureau and t he concerned st at e designat ed agency; zyxwvutsrqponmlkjihgfedcbaZYXWVUTSRQPONMLKJIHGFEDCBA

( c)

calculat e t he specific energy consum pt ion for t he baseline year as well as for t he t arget year and norm alise it by t aking int o t he capacit y ut ilisat ion, m ix of gr id and capt ive elect r icit y, and any ot her fact or w hich affect s ener gy consum pt ion as specified in t he Schedule;

( d)

calculat e t he annual specific energy consum pt ion in t he baseline year by ing t he dat a in t he previous t hree years, year- wise, using t he dat a subm it t ed by t he designat ed consum ers' under Rules 2007 and if verified, under Rules 2008; calculat e t he effect of capacit y ut ilisat ion and ot her fact ors if any, on t he specific energy consum pt ion for t he previous t hree years; calculat e t he specific energy consum pt ion, product ion, capacit y ut ilisat ion, in t he baseline year by t aking t he average of t he previous t hree years in t he first cycle and for subsequent cycles, t he provisions of rule 14 shall apply; t ake int o considerat ion t he effect on capacit y ut ilisat ion or t he plant load fact or or average energy consum pt ion in t he t arget year on of any of t he following fact ors, nam ely: ( i) nat ural disast er; or ( ii) riot ing or social unrest ; or ( iii) m aj or change in t he Governm ent policy including environm ent al st andards; or ( iv) im pact of m arket ( short age of raw m at erial or sales) in any of t he previous t hree years.

( 2) The said t echnical com m it t ee shall prepare a report cont aining designat ed consum er- specific basis of m et hodology referred t o in sub- rule 2 of rule 3, consult at ion wit h t he designat ed consum ers, and subm it t he said report t o t he Bureau. ( 3) The Bureau shall exam ine t he report subm it t ed under sub- rule ( 2) and finalise it s report cont aining it s recom m endat ion regarding t he energy consum pt ion norm s and st andards for each designat ed consum ers' plant . ( 4) The det ails regarding m et hodology used, form ulae adopt ed, except ions considered, principles adopt ed, for preparat ion of energy consum pt ion norm s and st andards shall be as specified in t he Schedule. The Bureau shall subm it t he report referred t o in sub- rule ( 3) t o t he Cent ral ( 5) Governm ent . ( 6)

The Cent ral Governm ent aft er considering t he said report shall by not ificat ion,-

( a) est ablish and specify t he energy consum pt ion norm s and st andards for every designat ed consum ers' plant under clause ( g) of sect ion 14; ( b) give direct ion t o all designat ed consum ers for com pliance wit h t he energy consum pt ion norm s and st andards under clause ( n) of sect ion 14and inform t he Bureau and all t he St at e designat ed agencies. 5. Form , m anner and t im e for preparat ion of schem e for im plem ent at ion of efficient use of energy and it s conservat ion.- ( 1) Every designat ed consum er, wit hin t hree m ont hs of t he issue of not ificat ion under sub- rule ( 6) of rule 4 shall subm it a schem e t o St at e designat ed agency wit h a copy t o Bureau, which m ay include ( a)

act ion plan cont aining zyxwvutsrqponmlkjihgfedcbaZYXWVUTSRQPONMLKJIHGFEDCBA inter-alia, a brief descript ion of ident ified energy saving m easures t o com ply energy consum pt ion norm s and st andards by t he t arget year;

( b)

t he est im at ed cost of each ident ified energy saving m easures;

( c) im plem ent at ion plan t o achieve energy consum pt ion norm s and st andards t hrough im plem ent at ion of energy saving m easures or t hrough purchase of energy savings cert ificat es.

6. Assessm ent of perform ance.- ( 1) Every designat ed consum er, wit hin t hree m ont hs of t he conclusion of t he t arget year from t he baseline year shall subm it t o t he St at e designat ed agency, wit h a copy t o t he Bureau, t he perform ance assessm ent docum ent in Form 'A' covering t he perform ance for t he relevant cycle specifying t he com pliance wit h energy consum pt ion norm s and st andards, duly verified t oget her wit h cert ificat e in Form 'B' given by t he accredit ed energy audit or and accom panied by t he following docum ent s, nam ely: ( a)

copy of unique num ber of regist rat ion given t o t he designat ed consum er;

( b)

proof of t im ely subm ission of report s in Form 1 under Rules 2007 for t he previous t hree years;

( c)

proof of t im ely subm ission of report s in Form 1, Form I I and Form I I I under Rules 2008 along wit h copies t hereof including t he report s for t he t arget year;

( d)

det ails of energy savings m easures im plem ent ed for com pliance wit h t he energy consum pt ion norm s and st andards in Form I I and Form I I I of Rules 2008, for each year, covering t he relevant cycle enclosing t herewit h, a brief about t he year- wise energy savings m easures, det ails of invest m ent m ade, phot ographs in of m easures im plem ent ed in each year, if

feasible, and percent age im provem ent in energy savings achieved in every year following t he baseline year unt il t he t arget year;

( e) det ails of energy consum pt ion norm s and st andards of t he designat ed consum ers in t he baseline year, achievem ent m ade in every year following t he baseline year and upt o t he t arget year t oget her wit h t he opinion of t he accredit ed energy audit or on t he achievem ent of energy consum pt ion norm s and st andards, ent it lem ent or requirem ent of energy savings cert ificat es along wit h t he det ails of calculat ion and correct ness of ent it lem ent or requirem ent duly cert ified by t he accredit ed energy audit or; zyxwvutsrqponmlkjihgfed

nam e and part iculars of t he energy m anager, his dat e of appoint m ent , det ails of dut ies per for m ed including init iat iv es under t ak en for im provem ent in energy conservat ion and energy efficiency.

( 2) The designat ed consum er, wit hin t hree m ont hs aft er t he end of first or second year of t he relevant cycle, m ay subm it perform ance assessm ent docum ent in Form 'A' t o t he St at e designat ed agency, wit h a copy t o t he Bureau, for issuance of proport ionat e energy savings cert ificat es covering t he perform ance for a period of not less t han one year from t he dat e of not ificat ion specifying t he energy consum pt ion norm s and st andards, duly verified t oget her wit h cert ificat e in Form 'B' given by accredit ed energy audit or along wit h t he docum ent s m ent ioned in sub- rule ( 1) . ( 3) The accredit ed energy audit or shall independent ly evaluat e each act ivit y undert aken by t he designat ed consum er for com pliance wit h t he energy consum pt ion norm s and st andards and ent it lem ent or requirem ent of energy savings cert ificat e, t o ensure t hat t hey m eet wit h t he requirem ent s of t hese rules. ( 4) The accredit ed energy audit or, in order t o assess t he correct ness of t he inform at ion provided by t he designat ed consum er regarding t he com pliance wit h energy consum pt ion norm s and st andards shall( a)

apply st andard audit ing t echniques;

( b)

follow t he rules and regulat ion fram ed under t he Act ;

( c)

int egrat e all aspect s of verificat ion, and cert ificat ion funct ions;

( d)

m ake independent t echnical review of t he opinion and decision of t he verificat ion t eam ; also t ake int o considerat ion, a sit uat ion where a part icular act ivit y m ay or m ay not form part of t he act ivit ies relat ed t o t he com pliance wit h t he energy consum pt ion norm s and st andards, and t he procedure for t he assessm ent shall include,-

( e)

( A) docum ent review, involving7

( i) r ev iew of dat a and it s sour ce, and infor m at ion t o ver ify t he correct ness, credibilit y and int erpret at ion of present ed inform at ion;

( ii) cross checks bet ween inform at ion provided in t he audit report and, if com parable inform at ion is available from sources ot her t han t hose used in t he audit report , t he inform at ion from t hose ot her sources and independent background invest igat ion; zyxwvutsrqponmlkjihgfedcbaZYXWVUTSRQPONMLKJIHG (B) follow up act ion, involving-

( i) sit e visit s, int erviews wit h personnel responsible in t he designat ed consum ers' plant ; ( ii) cross- check of inform at ion provided by int erviewed personnel t o ensure t hat no relevant inform at ion has been om it t ed or, over or under valued; ( iii) review of t he applicat ion of form ulae and calculat ions, and report ing of t he findings in t he verificat ion report . (5) The accredit ed energy audit or shall report t he result s of his assessm ent in a verificat ion report and t he said report shall cont ain,( a) t he sum m ary of t he verificat ion process, result s of assessm ent and his opinion along wit h t he ing docum ent s; ( b) t he det ails of verificat ion act ivit ies carried out in order t o arrive at t he conclusion and opinion, including t he det ails capt ured during t he verificat ion process and conclusion r elat ing t o com pliance w it h ener gy consum pt ion nor m s and st andards, increase or decrease in specific energy consum pt ion wit h reference t o t he specific energy consum pt ion in t he baseline year; ( c) t he record of int eract ion, if any, bet ween t he accredit ed energy audit or and t he designat ed consum er as well as any change m ade in his assessm ent because of t he clarificat ions, if any, given by t he designat ed consum er. (6) I f t he accredit ed energy audit or records a posit ive opinion in his verificat ion report , t he Bureau shall consider t hat all t he requirem ent s wit h regard t o t he com pliance wit h energy consum pt ion norm s and st andards, ent it lem ent about issue or liabilit y t o purchase energy savings cert ificat e have been m et . (7) Aft er subm ission of duly verified Form 'A' by designat ed consum er, st at e designat ed agency m ay convey it s com m ent s, if any, on Form 'A' t o t he Bureau wit hin fift een days of t he last dat e of subm ission of Form ` A'.

7. Procedure for m onit oring and verificat ion.- ( 1) The designat ed consum er in consult at ion wit h t he accredit ed energy audit or, shall put in place t ransparent , independent and credible m onit oring and verificat ion arrangem ent s for energy consum pt ion and product ion based on t he Bureau of Energy Efficiency ( Manner and I nt ervals of Tim e for Conduct of Energy Audit ) Regulat ions, 2010 for com pliance wit h t he energy consum pt ion norm s and st andard, and t he said arrangem ent s shall include,( a) preparat ion and m aint enance of quart erly dat a report s by t he designat ed consum ers( i) on t he perform ance of t he plant and product ion processes; ( ii) on t he int ernal field audit s of plant and product ion processes for t he purpose of ident ificat ion of fact ors inhibit ing im provem ent s in energy efficiency and conservat ion, and t aking of m easures t o reduce energy consum pt ion and t o im prove energy efficiency. ( b) preparat ion and m aint enance of yearly dat a report s by t he designat ed consum ers( i) on t he perform ance of plant and product ion processes; ( ii) on t he out com e of int ernal field audit s of plant and product ion processes ident ifying fact ors inhibit ing im provem ent s in energy efficiency and it s conservat ion, and t aking of m easures t o reduce energy consum pt ion and im prove energy efficiency and m easures t aken t o im prove t he efficiency of t he product ion processes during each year; ( iii) regarding a year- wise report on product ion achieved, energy consum ed, and specific energy consum pt ion achieved, specific energy consum pt ion reduct ion achieved, m easures adopt ed for energy conservat ion and quant it y of energy saved; (c)

preparat ion and m aint enance of t he end of t he cycle dat a report s on product ion achieved, energy consum ed, specific energy consum pt ion achieved, specific energy consum pt ion reduct ion achieved, m easures adopt ed for energy conservat ion and quant it y of energy saved.

( 2) All t he act ivit ies undert aken by t he designat ed consum ers under t hese rules shall be scrut inised by t he accredit ed energy audit or for t he purpose of preparat ion of verificat ion report and t he designat ed consum er shall furnish t he full and com plet e dat a, provide necessary docum ent s and ot her facilit ies required by t he accredit ed energy audit or for t he purpose of perform ing t he funct ion of verificat ion under t hese rules. 8. Check- verificat ion.- ( 1) The Bureau m ay on it s own, or on receipt of a com plaint regarding any error or inconsist ency or m isrepresent at ion, wit hin one year from t he dat e 9

of subm ission of t he com pliance report or wit hin six m ont hs from t he dat e of issue of energy savings cert ificat es, whichever is lat er, shall init iat e act ion for review of com pliance report in accordance wit h t he provision of sub- rule ( 2) . ( 2) The Bureau shall init iat e act ion in accordance wit h t he following procedure, nam ely(a)

a not ice shall be issued t o t he designat ed consum er as well as t o t he accredit ed energy audit or who had subm it t ed t he verificat ion report wit h a copy t o relevant st at e designat ed agency, t o provide com m ent s in reply t o t he said not ice wit hin t en working days from t he dat e of receipt of aforesaid notice;

( b) t he com m ent s furnished by t he designat ed consum er and accredit ed energy audit or shall clearly st at e t hat ( i)

t hey st and by t he com pliance report and verificat ion report subm it t ed by t hem and subm it a confirm at ion report giving point wise replies wit h necessary docum ent s in response t o t he said not ice; or

( ii)

t hey accept t he errors or inconsist encies or m isrepresent at ion point ed out in t he aforesaid not ice and shall give det ailed explanat ions in respect of each point in t he not ice and work out t he im pact of such errors or inconsist encies or m isrepresent at ion on t he subm it t ed com pliance report;

( c) wit hin t en working days from t he dat e of t he receipt of t he com m ent s referred t o in clause ( b) ,Bur eau shall aft er t aking int o consider at ion t he said com m ent s, decide t o undert ake or not t o undert ake review and t he Bureau shall record t he reasons in writ ing for it s decision; ( d) where t he Bureau, in consult at ion wit h st at e designat ed agency, decides t o undert ake review, ( i) it shall appoint an accredit ed energy audit or, who has not perform ed t he ver ificat ion funct ions w it h r espect t o t he concer ned designat ed consum er, t o conduct t he check- verificat ion; ( ii)

on a com plaint , t he said check- verificat ion shall be carried out at t he cost of t he com plainant ;

( e) where t he Bureau decides not t o undert ake t he said review, t he designat ed consum er, his accredit ed energy audit or, and t he com plainant shall be inform ed in t hat regard in writ ing. ( 3) The check- verificat ion process shall involve assessm ent t o ensure t hat , — 10

( a)

t he act ivit ies relat ing t o t he com pliance wit h energy consum pt ion norm s and st andards have been perform ed and t he issue or purchase of energy savings cert ificat e are in accordance wit h t he provisions of t hese rules;

( b)

t he m onit oring and verificat ion process are in accordance wit h t he provisions of rule 6;

( c)

t he det ails of t he dat a and t he act ivit ies referred t o in rule 7 are evaluat ed and conclusion m ade t hat errors, om issions or m isrepresent at ions or aggregat ion t hereof in t he said dat a do not affect t he energy consum pt ion norm s and st andards achieved by t he act ivit ies and issue or purchase of energy savings cert ificat es by m ore t han t he t hreshold lim it specified in t he Schedule. zyxwvutsrqponmlkjihgfedcba

(4) The said accredited energy auditor shall assess and that the activities performed by the designated consumer for compliance with the energy consumption norms and standards are in accordance with these rules, and the assessment and check- verificat ion process shall involve— ( a)

a review of t he docum ent s as well as t he on- sit e assessm ent referred t o in rule 6t o t hat t he act ivit ies pert hrm ed t o com ply wit h t he energy consum pt ion norm s and st andards are in accordance wit h t hese rules and in case t he aforesaid accredit ed energy audit or decides t hat it was not possible or appropriat e t o m ake a sit e visit , t hen he shall record reasons in writ ing in t his regard; ( b) a review of bot h quant it at ive and qualit at ive inform at ion on t he energy consum pt ion norm s and st andards, t he quant it at ive inform at ion com prising of t he report ed dat a in 'Form A'. and t he qualit at ive inform at ion com prising of inform at ion on int ernal m anagem ent cont rols, calculat ion procedures, procedures for t ransfer of dat a, frequency of energy consum pt ion norm s and st andards achieved every year following t he baseline year unt il t he t arget year, report s and review of int ernal field audit of calculat ions or dat a t ransfers; ( c)

a review of previous verificat ion report s;

( d) a review of any ot her inform at ion and docum ent s relevant t o or having a bearing on t he act ivit ies perform ed under t hese rules; ( e)

a review of t he m onit oring and verificat ion process referred t o in rule 7.

(5) The designat ed consum er shall furnish full and com plet e dat a, provide necessary docum ent s and ot her facilit ies required by t he accredit ed energy audit or for t he purpose of perform ing t he funct ion of check- verificat ion under t hese rules,

The accredit ed energy audit or in- charge of check- verificat ion funct ion shall report (6) t he result s of his assessm ent in a check- verificat ion report and t he said report shall cont ain,( a) t he sum m ary of t he verificat ion process, result s of his assessm ent and his opinion along wit h t he ing docum ent s; ( b) t he det ails of check- verificat ion act ivit ies carried out in order t o arrive at t he conclusion and opinion including t he det ails capt ured during t he verificat ion process and conclusion relat ing t o com pliance wit h energy consum pt ions norm s and st andards, increase or decrease in specific energy consum pt ion wit h reference t o t he specific energy consum pt ion in t he baseline year, ent it lem ent about t he issue or liabilit y t o purchase energy savings cert ificat e. I f t he accredit ed energy audit or records in his check- verificat ion report , a posit ive (7) opinion, it shall be concluded t hat all t he requirem ent s wit h regard t o t he com pliance wit h energy consum pt ion norm s and st andards and t he issue or purchase of energy savings cert ificat es have been m et . I f t he accredit ed energy audit or records in his check- verificat ion report , a (8) negat ive opinion, t he effeCt of such opinion on t he energy consum pt ion norm s and st andards, issue or purchase of energy savings cert ificat e, t he liabilit y of t he accredit ed energy audit or in giving t he verificat ion report and am ount of t he unfair gain gained by t he designat ed consum er as a result of such verificat ion report shall be calculat ed by t he accredit ed energy audit or conduct ing t he check- verificat ion. The accredit ed energy audit or in- charge of check- verificat ion shall subm it his (9) report wit h due cert ificat ion in Form 'C' t o t he Bureau and t he concerned St at e Designat ed Agency. Where t he verificat ion report given by t he accredit ed energy audit or secures an (10) unfair or undue gain due t o t he deficiencies or inconsist encies or er r or s or m isrepresent at ion by t he designat ed consum er, t he quant um of such gain shall be calculat ed having regard t o t he following fact ors, nam ely: ( a) t he value of t he am ount payable by such designat ed consum er shall be as worked out in t he verificat ion report plus t went y- five per cent . of such value because of unfair pract ice used by t he said designat ed consum er for obt aining unfair advant age; ( b)

t he am ount of m et ric t on of oil equivalent of energy specified because of unfair gain ident ified due t o check- verificat ion;

( c)

cost of check- verificat ion.

(11) The State designated agency may furnish its comments on the report within ten days from the receipt of the report from the said accredited energy auditor and in case zyxwvutsrqponm no com m ent s are received from t he concerned st at e designed agency, it shall be presum ed t hat t hey have no com m ent s t o offer in t he m at t er. (12) The Bureau aft er t he expiry of t en days referred t o in sub- rule ( 11) , shall issue show cause not ice t o t he designat ed consum er as well as t o his accredit ed energy audit or specifying t he deficiencies or inconsist encies or errors or m isrepresent at ion not iced against t he designat ed consum er and his accredit ed energy audit or. (13) The designat ed consum er as well as his accredit ed energy audit or shall subm it t heir replies t o t he said show cause not ice wit hin a period of fift een working days t o t he officer of t he Bureau who has issued t hat show cause not ice. (14) The Bureau aft er exam ining t he said replies t o t he show cause not ice referred t o in sub-rule (13), shall forward the report to the concerned State designated agency specifying the following details for the purpose of initiating the penalty proceedings, namely:( a)

t he num ber of energy savings cert ificat es wrongfully obt ained by t he designat ed consum er on t he basis of verificat ion report found t o be wrong and false on check- verificat ion;

(b)

the number of energy savings certificates which the designated consumer was liable to purchase for non-compliance with the energy consumption norms and standards as found in the check-verification report;

(c)

details of the misrepresentation, if any and the unfair gain due to such misrepresentation;

(d)

the cost of check- verification.

(15) The State designated agency within two months from the date of the receipt of the report referred to in sub-rule (9) shall initiate( a)

act ion t o recover from t he designat ed consum er t he loss t o t he Cent ral Government by way of unfair gain to the designated consumer; penalty proceedings against the persons mentioned in t he said report , under intimation to the Bureau; complaint for such fraudulent unfair gain if designat ed consum er does not pay penalt y and loss t o t he exchequer in t he specified t im e m ent ioned in t he penalt y proceedings.

(16) Where the check-verification has been initiated on the basis of a complaint received by the Bureau, the cost of check-verification shall be borne by the complainant,

in case it was found on check- verificat ion t hat t he designat ed consum er has subm it t ed correct inform at ion in Form 'A'. (17) Where t he check- verificat ion has been init iat ed on t he basis of a com plaint received by t he Bureau, t he cost t hereof shall be borne by t he designat ed consum er in case it was found on check- verificat ion t hat t he designat ed consum er has subm it t ed false and incorrect inform at ion in Form 'A'. 9. Procedure regarding com pliance wit h energy consum pt ion norm s and st andards and issue of energy savings cert ificat e.- ( 1) A firm regist ered under t he I ndian Part nership Act , 1932 ( 9 of 1932) or a com pany incorporat ed under t he Com panies Act , 1956 ( 1 of 1956) or any ot her legal ent it y com pet ent t o sue or t o be sued or ent er int o cont ract s shall be ent it led t o undert ake verificat ion and check- verificat ion regarding com pliance wit h t he energy consum pt ion norm s and st andards and issue or purchase of energy savings cert ificat e if it ,( a) has at least one accredit ed energy audit or whose nam e is included in t he list of t he accredit ed energy audit ors m aint ained by t he Bureau under regulat ion 7 of t he Bureau of Energy Efficiency ( Qualificat ions for Accredit ed Energy Audit ors and Maint enance of t heir List ) Regulat ions, 2010; ( b) has at least t hree energy audit ors; (c

)

has adequat e expert ise of field st udies including observat ions, probing skills, collect ion and generat ion of dat a, dept h of t echnical knowledge and analyt ical abilit ies for undert aking verificat ion and check- verificat ion;

( d) has a m inim um t urnover of t en lakhs rupees per annum in at least one of t he previous t hree years or in case of a newly form ed organisat ion, a net wort h of t en lakhs rupees. ( 2) The Bureau shall invit e applicat ions from t he firm s, com panies and ot her legal ent it ies t o undert ake t he work of verificat ion and check- verificat ion for t he purpose of preparing a of such firm s, com panies and ot her legal ent it ies. ( 3) The applicat ions referred t o in sub- rule ( 2) shall be accom panied by a cert ificat e of regist rat ion or incorporat ion as t he case m ay be. ( 4) The applicat ions so received shall be scrut inised in accordance w it h t he provisions of sub- rule( 1) and a of eligible applicant s shall be prepared which shall be displayed on t he web sit e of t he Bureau, t hat is, www.bee- india.nic.in . ( 5) The select ed applicant s shall be issued a cert ificat e of em m ent in t heir select ion t o undert ake t he funct ion of verificat ion and check- verificat ion as accredit ed energy audit or. zyxwvutsrqponmlkjihgfedcbaZYXWVUTSRQPONMLKJIHGFEDCBA

( 6) A unique ident ificat ion num ber shall be issued t o t he accredit ed energy audit ors referred t o in sub- rule ( 5) . 10. Obligat ions of accredit ed energy audit or.- ( 1) For t he work of verificat ion or check verificat ion, t he accredit ed energy audit or shall const it ut e a t eam com prising of a t eam head and ot her m em bers including expert s: Provided t hat a person who was in t he em ploym ent of a designat ed consum er wit hin t he previous four years, shall not be eligible t o perform t he work of verificat ion or check- verificat ion for such designat ed consum er; Provided furt her t hat any person or firm or com pany or ot her legal ent it y, who was involved in undert aking energy audit in any of t he designat ed consum er wit hin t he previous four years, shall not be eligible t o perform t he work of verificat ion or checkverificat ion for such designat ed consum er. ( 2) The accredit ed energy audit or shall ensure t hat persons select ed as t eam head and t eam m em bers m ust be independent , im part ial and free of pot ent ial conflict of int erest in relat ion t o act ivit ies likely t o be assigned t o t hem for verificat ion or checkverificat ion. (3) The accredit ed energy audit or shall have form al cont ract ual condit ions t o ensure t hat each t eam m em ber of verificat ion and check- verificat ion t eam s and t echnical expert s act in an im part ial and independent m anner and free of pot ent ial conflict of interest. ( 4) The accredit ed energy audit or shall ensure t hat t he t eam head, t eam m em bers and expert s prior t o accept ing t he assignm ent inform him about any known, exist ing, form er or envisaged link t o t he act ivit ies likely t o be undert aken by t hem regarding verificat ion and check verificat ion. ( 5) The accredit ed energy audit or m ust have docum ent ed syst em for det erm ining t he t echnical or financial com pet ence needed t o carry out t he funct ions of verificat ion and check - verificat ion and in det erm ining t he capabilit y of t he persons referred t o in sub- rule ( 2) , t he accredit ed energy audit or shall consider and record am ong ot her t hings t he following aspect s, nam ely: ( a) com plexit y of t he act ivit ies likely t o be undert aken; ( b) risks associat ed wit h each proj ect act ivit y; ( c) t echnological and regulat ory aspect s; ( d) size and locat ion of t he designat ed consum er; ( e) t ype and am ount of field work necessary for t he verificat ion or checkverificat ion.

(6) The accredit ed energy audit or shall have docum ent ed syst em for preparing t he plan for verificat ion or check- verificat ion funct ions and t he said plan shall cont ain all t he zyxwvutsrqponmlkjihgfe 15

t asks required t o be carried out in each t ype of act ivit y, in t erm s of m an days in respect of designat ed consum ers for t he purpose of verificat ion and check - verificat ion. (7) The nam es of t he verificat ion or check- verificat ion t eam m em bers and t heir biodat a shall be provided by t he accredit ed energy audit or t o t he concerned designat ed consum er in advance. (8) The verificat ion or check- verificat ion t eam shall be provided by t he accredit ed ener gy audit or w it h t he concer ned w or k ing docum ent s indicat ing t heir full responsibilit ies wit h int im at ion t o t he concerned designat ed consum er. (9)

The accredit ed energy audit or shall have docum ent ed procedure( i) t o int egrat e all aspect s of verificat ion or check- verificat ion funct ions; ( ii) for dealing wit h t he sit uat ions in zyxwvutsrqponmlkjihgfedcbaZYXWVUTSRQPONMLKJIHGFEDCBA which an act ivit y undert aken for t he purpose of com pliance wit h t he energy consum pt ion norm s and st andards or issue of energy savings cert ificat e shall not be accept able as an act ivit y for t he said purposes.

( 10) The accredit ed energy audit or shall conduct independent review of t he opinion of verificat ion or check- verificat ion t eam and shall form an independent opinion and give necessary direct ions t o t he said t eam if required. (11) I n preparing t he verificat ion and check- verificat ion report s, t he accredit ed energy audit or shall ensure t ransparency, independence and safeguard against conflict of int erest . ( 12) The accredit ed energy audit or shall ensure t he confident ialit y of all inform at ion and dat a obt ained or creat ed during t he verificat ion or check verificat ion report . ( 13) I n assessing t he com pliance wit h t he energy consum pt ion norm s and st andards and issue of energy savings cert ificat es, t he accredit ed energy audit or shall follow t he provisions of t he Act , rules and regulat ions m ade t hereunder. (14) Aft er com plet ion of t he check- verificat ion, t he accredit ed energy audit or shall subm it t he check- verificat ion report , t oget her wit h t he cert ificat e in Form - 'C', t o t he Bureau. 11. Recom m endat ion for issue of energy savings cert ificat es.- ( 1) The Bureau on sat isfying it self about t he correct ness of verificat ion report , and check- verificat ion report , wherever sought by it , send it s recom m endat ion under clause ( aa) of sub- sect ion ( 2) of sect ion 13 t o t he Cent ral Governm ent , based on t he claim raised by t he designat ed consum er in Form ` A', wit hin t en working days from t he last dat e of subm ission of said Form ` A' by t he concerned st at e designat ed agency, for issuance of energy savings cert ificat es under sect ion 14A and t he recom m endat ion shall specify.-

( 3) The t ot al am ount of energy savings cert ificat es recom m ended under sub rule ( 2) shall be adj ust ed against t he ent it lem ent on conclusion of t he t arget year as per t he following form ulae: ( A) for t herm al power plant sect or:

Procedure for issue of energy savings cert ificat e.- ( 1) The Cent ral Governm ent , on t he receipt of recom m endat ion from t he Bureau under rule 10, shall on sat isfying it self in t his regard, issue energy savings cert ificat es of required value t o t he concerned designat ed consum er wit hin fift een working days from t he dat e of receipt of such recom m endat ion from t he Bureau. ( 2)

The energy savings cert ificat e shall be issued in elect ronic form .

The value of one energy savings cert ificat es shall be equal t o one m et ric t on of ( 3) oil equivalent of energy consum ed. ( 4) The designat ed consum er who has been issued energy savings cert ificat es m ay sell t hem t hrough t he power exchange.

( 5) The designat ed consum er who has been issued t he energy savings cert ificat es during t he current cycle m ay use t hem for t he purpose of banking unt il t he next com pliance cycle. ( 6) The energy zyxwvutsrqponmlkjihgfedcbaZYXWVUTSRQPONMLKJIHGFEDCBA savings certificates issued in a cycle period shall remain valid till t he com plet ion of t he com pliance period of t he next cycle. The energy savings cert ificat es purchased by a designat ed consum er for t he ( 7) purpose of com pliance wit h t he energy consum pt ion norm s and st andards shall aft er t heir subm ission t o t he Bureau st and expired. 13. Com pliance of energy consum pt ion norm s and st andards.- ( 1) The designat ed consum er for t he purpose of achieving t he com pliance wit h t he energy consum pt ion norm s and st andards during t he t arget year, in t he relevant cycle shall t ake t he following act ion and aft er com plet ing t he said act ion, furnish t he st at us of com pliance t o t he concerned st at e designat ed agency wit h a copy t o t he Bureau in Form D' by t he end of five m ont hs from t he last dat e of subm ission of Form ` A'( a) by im plem ent at ion of energy conservat ion and energy efficiency im provem ent m easures or; ( b) where t he m easures im plem ent ed in t erm s of clause ( a) are found inadequat e for achieving com pliance wit h t he energy consum pt ion norm s and st andards, t he designat ed consum er shall purchase t he energy savings cert ificat es equivalent in full sat isfact ion of t he short fall in t he energy consum pt ion norm s and st andards worked out in t erm s of m et ric t on of oil equivalent . 14. Est ablishm ent of new baseline for next cycle.- The energy consum pt ion norm s and st andards achieved by t he designat ed consum er on t he com plet ion of t he t arget year, as m ent ioned in t he com pliance report in Form - 'D' shall be t he baseline for est ablishm ent of new plant specific energy consum pt ion norm s and st andards for designat ed consum ers for t he next cycle. 15.

Obligat ions of t he designat ed consum ers.- The designat ed consum ers shall,( a) for assessm ent of t heir perform ance for com pliance w it h t he energy consum pt ion norm s and st andards, get t he work of verificat ion done t hrough accredit ed energy audit ors; ( b) t ake all m easures including im plem ent at ion of energy efficiency proj ect s recom m ended by t he accredit ed energy audit or and good pract ices prevalent or in use in t he concerned indust rial sector so as t o achieve t he opt im um use of energy in t heir plant :

(c) furnish the full and complete data, provide necessary documents and other facilities required by the accredited energy auditor for the purpose of performing the function of verification and check-verification. 16.

Specification of value of energy.-(1) The value of per metric ton of oil equivalent of energy consumed shall be determined by applying the following formula, namely:P=Wc x Pc+Wo x Po+Wg x Pg + We x Pe WhereP =price of one metric ton of oil equivalent(ltoe); Pc=average price of delivered coal; Po=price of fuel oil as declared by Indian Oil Corporation Limited; Pg=price of gas as declared by Gas Authority of India Limited; Pe = average price of one unit of electricity for industrial sector in the States of Chattisgarh, Gujarat, Maharashtra, Madhya Pradesh and Tamil Nadu as specified by the respective State Electricity Regulatory Commission; all prices shall be as on 1st April of the year for which value of energy is being specified. zyxwvutsrqponmlkjihgfedcbaZYXWVUTSRQPONMLKJIHGFEDCBA

Determination of baseline specific energy consumption.-

1.1 zyxwvutsrqpo Specific energy consumption (See rule 2(I )) (a)

The specific energy consumption (SEC) gives the indication of efficient utilisation of different

sources of energy in a plant operational boundary to produce one unit of product, which is defined as the ratio of total energy input to plant boundary and the quantity of products produced and specific energy consumption of an industry shall be calculated based on Gate-to-Gate concept with the following formula: Specific Energy Consumption = Net energy input into the designated consumers' boundary Total quantity of output exported from the designated consumers' boundary and expressed in of the metric ton of oil equivalent (toe)/ per unit of product; Note: value to be rounded to three decimal places.

As the specific energy consumption (SEC) is calculated on a Gate-to-Gate concept, the plant zyxwvutsrqponm

Norm alisat ion, in a suit able st at ist ical approach, shall be done in case of abnorm alit y in capacit y ut ilisat ion in any of t he aforesaid t hree year ( s) . ( b)

During t he first cycle designat ed consum er having m ore t han five years life and less t han t hree years dat a has been report ed, t he sam e shall be considered provided t he capacit y ut ilisat ion is uniform and if t he capacit y ut ilisat ion is abnorm ally low in any of t he aforesaid t hree year( s) , t he sam e shall not be considered. ( c)

utilisation is uniform. I f the capacity utilisation is abnormally low in any of the year(s), the same shall not be considered. (d)

During the first cycle, in case of new designated consumer, the data shall be considered for

those years where the capacity utilisation is greater than seventy percent. (70% ) and if only one year data is reported, the same shall be considered irrespective of the capacity utilisation.

(e)

in the next cycle, baseline specific energy consumption shall be calculated in accordance

with the provisions of rule 14. (e) Few additional sector specific information like process technology, process flow, raw material, product mix etc. shall also be collected. All forms of energy shall be converted into a single form i.e. metric ton of oil equivalent (toe)

(f)

by the use of standard engineering conversion formula and the following general guiding principle shall be used in this regard: - zyxwvutsrqponmlkjihgfedcbaZYXWVUTSRQPONMLKJIHGFEDCBA

(1)

The reported gross calorific value (GCV) of fuels by the designated consumer, shall be considered for estimating the equivalent thermal energy.

(ii) I f gross calorific value (GCV)is not reported, then the values mentioned in the Government

of I ndia, Ministry of Power, notification number 5.0 394(E), dated the 12zyxwvutsrqponmlkjihgfedcbaZYXWVUTSRQPONMLKJIHGFEDCBA th March, 2007 shall be considered. Any other information as required shall be .taken from standard industrial practice. (iii) The equivalent thermal energy of the electricity supplied to the grid shall be deducted from the total energy input to the designated consumers' boundary. The following expression shall be used: Equivalent thermal energy (kCal)= Electricity supplied to grid(kWh) x national average heat rate in kCal/ kWh in the baseline year. National average heat rate in year 2009-10 was 2717 kCal/ kWh. (iv) Total energy input to the designated consumers' boundary shall be estimated with the following expression: Energy input (toe) = Fuel consumed quantity (kg) x gross calorific value (kCal/ kg) 10 (v) Once the total energy input to the designated consumers' boundary is estimated, the specific energy consumption shall be calculated by dividing the product quantity.

1.4 zyxwvutsrqp Procedure for normalisation of specific energy consumption.(a)

Variable fact ors as described in rule 4 may affect t he energy consumpt ion and

` Normalisation Factors' shall be considered in those cases. Capacity utilisation is one of the most import ant paramet ers t o have a normalisat ion fact or. The report ed specific energy consumption(SEC) shall be normalised after incorporating the normalisation factor.

The norm alisat ion procedure is proposed t o be applied if t he capacit y ut ilisat ion or Plant Load Fact or ( PLF) has a deviat ion of m ore t han t hirt y per cent . I t shall be applied only if capacit y ut ilisat ion has deviat ed due t o uncont rollable fact ors described in rule 4, and duly declared by t he designat ed consum er wit h aut hent ic proof or self cert ificat ionszyxwvutsrqponmlkjihgfedcbaZYXWVUTSRQPONMLKJIHG .

(d) The norm alisat ion shall be done by perform ing a st at ist ical analysis of t he specific energy consum pt ion and product ion dat a by( i) plot t ing t he product ion versus energy consum pt ion curves; ( ii) perform ing st at ist ical analysis t o represent t he relat ionship bet ween t he product ion and energy consum pt ion; ( iii) ext rapolat ing t he above relat ionship t o generat e capacit y ut ilisat ion versus energy consum pt ion and capacit y ut ilisat ion versus specific energy consum pt ion dat a for a suit able range of capacit y ut ilisat ion values; ( iv) t he average capacit y ut ilisat ion shall be used t o ident ify t he corresponding specific energy consum pt ion value; ( v) t he norm alised specific energy consum pt ion shall be t he value as com put ed in t he previous step; (e) The "capacit y ut ilisat ion" referred t o in clauses ( c) t o ( d) shall be replaced by "Plant Load Fact or" in case of designat ed consum ers in t he t herm al power plant sect or; ( f) The above calculat ion det erm ines t he norm alised specific energy consum pt ion for t he designat ed consum ers.

The designat ed consum ers for t he t herm al power plant sect or shall be grouped based on t he

fuel used and t hey are as under: -

of specific percent age of t heir present deviat ion of net operat ing heat rat e, based on t he average of previous t hree years, nam ely, 2007- 8,2008- 9,2009- 10 for t he first cycle ,arid for cycles t hereaft er in accordance wit h t he provision of rule 14from t he net design heat rat e.
